Scope and obligation to pay
Sales are concluded between the customer and OWLY LEARNING. These terms govern digital content supplied without a physical medium on holyowly.com and in application stores, for a consumer’s personal, non-commercial use. Every paid order entails an obligation to pay.
Only content selected by OWLY LEARNING is available free of charge. Access to all content included in a paid offer requires a subscription and an order subject to these terms.
The customer must have legal capacity to contract and be the end user or the legal representative of a minor user. The application uses common operating systems; customers must check their equipment’s compatibility.
Placing an order means accepting these terms in full. Different provisions require OWLY LEARNING’s prior written agreement. Failure to enforce a provision does not waive the right to enforce it later.
The terms in force on the order date apply. OWLY LEARNING may amend them and will notify customers by email, inviting them to accept the changes. Information and access reserved for personal use may not be transferred to a third party.
Orders, confirmation and access
Customers must complete all required fields with full, current and accurate information. They are responsible for entry errors, particularly in their email address, and for keeping and using their username and password securely.
An order for selected content becomes binding after full payment on the website or relevant store and order confirmation. Online confirmation is sent within 48 working hours. Customers must check receipt and notify OWLY LEARNING in writing by email or post if it is missing. Evidence of dispatch to the address exactly as entered in the order creates a presumption of receipt, subject to statutory rules of evidence.
The order and contract are personal to the customer: rights and obligations cannot be transferred wholly or partly to a third party. Once the order is validated, paid and confirmed, the credentials created provide access to the customer account and the application content covered by the selected offer.
Prices, invoicing and payment
Prices include all taxes and orders are payable in euros. OWLY LEARNING may change prices; the price in force when the order is recorded applies. The total including tax is displayed before payment is confirmed. No discount is given for early payment.
Orders are validated by full payment on the website or through the selected store’s payment system. Website payments are made by bank card; cheques are not accepted. Customers are responsible for paying the price and applicable charges and taxes. Subscription price changes are notified to customers.
Any credit or refund relating to an order is paid into the same account that was debited for that order. Customers must report relevant changes to payment details. Entering card details and finally confirming the order constitute evidence of the order and the amount due, subject to applicable statutory rules.
Promotional offers apply only during the stated period and to orders that become binding within that period.
Refund requests
For a website purchase, send your request under the commercial refund procedure to contact@holyowly.fr within two days of the debit. Each request is reviewed on a case-by-case basis; this procedure does not automatically guarantee a refund.
For a purchase billed by Apple, submit your request to Apple at reportaproblem.apple.com. For a purchase billed by Google Play, contact contact@holyowly.fr within two days of the debit and include the GPA order number shown on your invoice.
The two-day period concerns this commercial procedure and does not limit statutory rights. This procedure does not restrict any applicable right of withdrawal, statutory warranties or other statutory consumer rights.
Right of withdrawal and digital content
Confirming a purchase means accepting the terms of sale. For digital content supplied without a physical medium, loss of the right of withdrawal requires the customer’s express consent to supply beginning before the withdrawal period ends and express acknowledgement of the resulting loss of that right, in accordance with applicable law. Accepting general terms alone does not replace this consent and acknowledgement.
Where these requirements are met and supply has begun at the customer’s request, the right of withdrawal can no longer be exercised for that content. Statutory consumer rights continue to apply in other cases.
Subscription term, renewal and cancellation
The subscription duration is specified in the selected offer. Once access is available, customers decide how to use it. Not using a subscription, or using only part of its content, does not in itself justify a price reduction or refund, without prejudice to statutory consumer rights.
The contract runs for the selected term and then renews automatically for the same period under the subscribed offer’s conditions. Renewal takes place at the price applicable to subscriptions of the same duration on the renewal date, subject to statutory information requirements and rights.
Customers may stop renewal through the channel used for purchase. For Apple, cancellation must be requested at least 24 hours before the current period ends. A non-renewed subscription ends when the paid period expires. Uninstalling the application does not cancel the subscription.
Customers must keep identification, correspondence and payment information up to date, including at renewal.
Cancel a subscription purchased on the website
Sign in to your account, open Subscription and select the cancellation option for your current subscription. Complete the process through the final cancellation confirmation. Any offer to keep your subscription is not a cancellation. Once confirmed, your account shows that renewal has been stopped; access continues until the paid period ends. This process is for subscriptions purchased on the website, not those billed by Apple or Google.
Cancel an Apple subscription
- On your iPhone or iPad, open Settings and tap your name.
- Tap Subscriptions and select Holy Owly using the Apple Account used for the purchase.
- Tap Cancel Subscription and confirm following Apple’s instructions. If the option is missing, consult official help to check the subscription status and billing channel.
Cancel a Google Play subscription
- Open Google Play with the Google Account used for the purchase.
- Tap the profile icon, then Payments and subscriptions, then Subscriptions.
- Select Holy Owly, tap Cancel subscription and follow the instructions. Access continues until the paid period ends.
Warranties and liability
Free content lets customers explore the nature of the application and some of its content before ordering. OWLY LEARNING is bound by statutory warranties applicable to digital content. No provision of these terms limits those warranties or mandatory consumer rights.
During the subscription, customers are responsible for the functioning of their equipment, software, operating systems and tools needed for access. OWLY LEARNING supplies content in a standard format and develops it to meet application update needs and developments in playful language-learning content. Such development does not by itself change the subscription, subject to customers’ statutory rights.
OWLY LEARNING endeavours to keep the service functioning but does not guarantee uninterrupted access. Its obligation to use reasonable efforts applies only to the extent permitted by law and does not exclude statutory obligations concerning supply, conformity and warranties.
External links
OWLY LEARNING or third parties may provide links to other websites or resources. OWLY LEARNING does not control those external resources and does not guarantee their availability or content. Content accessible through them remains the responsibility of its publishers, subject to liability established by law.
Personal data and privacy
OWLY LEARNING respects your privacy. The privacy policy describes personal data processing and users’ rights.
Intellectual property
Texts, comments, voices, illustrations, images and other content on holyowly.com and in the Holy Owly application are protected worldwide by copyright and intellectual property rights. Only private use is authorised, subject to applicable law.
Outside private use and statutory exceptions, copying, reproducing, distributing, selling, publishing, exploiting or converting content into another format requires OWLY LEARNING’s prior authorisation. Reproduction of all or part of the application or its content is subject to applicable rights; unauthorised use may constitute infringement.
Force majeure
OWLY LEARNING and third parties involved in providing the service are not liable for failures or delays caused by events beyond their control where the legal requirements for force majeure are met. These may include acts of authorities, fires, floods, earthquakes, riots, wars, sabotage or network and telecommunications failures. The parties concerned must take all reasonable measures to mitigate the effects. A technical or IT incident does not automatically constitute force majeure.
Applicable law and disputes
The French version is authoritative. Sales are governed by French law without depriving consumers of mandatory protections under applicable law.
In the event of a dispute, the parties seek an amicable solution following written notice. If no agreement is reached within fifteen days, the dispute may be referred to the court competent under applicable rules. These terms do not impose exclusive jurisdiction of the courts at OWLY LEARNING’s registered office on consumers.
